General Terms and Conditions of Sale

 

 

Introduction

  

The general terms and conditions of sale detailed below govern the contractual relationship between the company Caffè Cataldi, registered on the register of companies and commerce in Ploufragan under the number 514 310 036 (hereafter referred to as  "Caffè Cataldi") and any individuals or businesses (hereafter referred to as “you”, “your”, or the “Customer”) wishing to place an order for goods or services via the internet site of "Caffè Cataldi".

Purpose

  

The general terms and conditions of sale detailed below govern the contractual relationship between Caffè Cataldi and the Customer along with any applicable conditions for any order placed via the Caffè Cataldi web site, whether the Customer is an individual or a business.

The acquisition of goods or services via the Caffè Cataldi web site implies that you accept unreservedly these general conditions of sale.

These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written, prior dispensation by Caffè Cataldi.

Caffè Cataldi reserves the right to modify these Terms and Conditions of Sale at any time. In such cases, the Customer will be subject to the policies and Conditions of Sale in force at the time that the order is placed and is confirmed by Caffè Cataldi by e-mail.

Characteristics of goods and services offered

 

  

The products and services on offer are those which feature in the online catalogue published on the Caffè Cataldi web site.

These products and services are offered in accordance with available stocks.

Each product is accompanied by a description provided by Caffè Cataldi.

Whilst the pictures included on the site are deemed to be as representative as possible, they are intended as a guide only and may not represent a true likeness of the product for sale.

Prices

  

In accordance with article 293 B of the General Tax Code in effect in France, all prices in the online catalogue of Caffè Cataldi are Net of tax and subsequently your invoice with be VAT free.

Caffè Cataldi reserves the right to modify its prices at any time, but commits to apply the tariffs provided at the time the Customer places their order.

The prices indicated do not include shipping and handling fees. These fees are calculated according to the total weight of the order, the choice of courier, and the geographical destination chosen by the Customer.

Orders

  

Any Customer wishing to purchase goods or a service must adhere to the following requirements. The Customer must:

-      select any products you wish to buy and configure them correctly;

-      fill out the user details, providing any and all required information, or supply a customer code if you possess one;

-      validate the order only after reviewing it;

-      make payment according to the terms and the selected payment method;

-      confirm the order and its details.

The confirmation of an order implies acceptance and full knowledge of these conditions of sale, and a waiver of any other conditions of purchase or terms of sale.

All data recorded and confirmed, will serve as proof of the Customer's transaction. Confirmation is equal to a binding signature and acceptance of all transactions.

Caffè Cataldi will send an e-mail confirming receipt of your order.

Cancellation Rights

 

The Customer is given the right to cancel their order. The cancellation period ends on the expiry of 7 working days, beginning on the day which the consumer receives the goods, during which time the Customer may return the product at their own expense for exchange or refund.

Payment Methods

 

Payment is due on completion of your order.

Payments may be made by credit card and your transaction will be processed via PayPal using a secure encrypted server employing the SSL protocol (Secure Socket Layer) ensuring that your details are kept secure when ordering over the internet. Payment may also be made via cheque, if delivery is to be made to your home. If you wish to collect your order from the roastery, then payment may be made by cash, in person.

Delivery

  

Delivery will only be made to the address provided when placing your order and is limited to the geographical zone provided on the Caffè Cataldi web site.

Transfer of risk of the purchased goods shall pass over to the Customer at the moment the goods leave Caffè Cataldi. In case of accidental destruction or deterioration during transportation, complaints should be made directly to the shipping company within 3 working days of reception of your goods.

Delivery dates are given solely as a guide; if delivery is not made within a period of thirty days, starting from confirmation of your order, the contract of sale may be cancelled and your order refunded.

Warranty

  

All goods (except for perishable items) provided by Caffè Cataldi are covered by legal warranty on defects in accordance with the provisions of article 1641 et sqq of the French Civil Code.

In the event of a manufacturing defect in the product, making it unfit for the use for which it was intended, you may apply to Caffè Cataldi in writing at:

You will then have the option of returning the goods, within a period of thirty days after receipt of delivery, for either exchange or a refund.

Liability

 

Caffè Cataldi, in the process of selling online, is bound only by a best efforts obligation and cannot be held responsible in case of damages resulting from your use of the Internet, such as any loss of data, intrusion, virus, rupture of service, or other involuntary problems.

All content included on the Caffè Cataldi website, such as text, graphics, logos is the property of Caffè Cataldi and is protected by international copyright, authors' rights and database rights laws. You may not systematically extract and/or re-utilise parts of the contents of the website, whether text, graphics, or audio clips for whatever purpose without the express written consent of Caffè Cataldi.

Any simple and/or deep link or framing towards the Caffè Cataldi website is strictly prohibited and consequently no element featured on a page of the Caffè Cataldi website may be partially or totally distributed/transferred to or inserted in another website without express written consent.

Data Protection

  

In accordance with “French Data processing and Freedoms” law (6th January 1978) information relative to the buyers may be subject to automated processing. Caffè Cataldi reserves the right, including the use of cookies, to extract, handle and use personal information relating to Buyers. You have a right of access to the information concerning you. Upon request, this information can be provided and, in the event of error or of modification, can be rectified. You may also prevent the communication of this information to any third party by making a request to Caffè Cataldi in writing.

In accordance with the "Data processing and Freedoms" law, the processing of your details, including the storing of emails, was the subject of a declaration made before the CNIL (French data protection watchdog)
on 22/10/2009 and is registered under the number 1392580.

Evidence - Records

 

Caffè Cataldi will retain copies of the purchase orders, confirmations of orders and invoices on a reliable and irreversible medium in such a way as to correspond to a faithful and durable copy in accordance with article 1348 of the French Civil Code. The computerised registers of Caffè Cataldi will be regarded as evidence of the communications, orders and payments occurred between the parties.

Applicable Law

  

The present conditions are subject to French law.

In the case of litigation and failure to reach an amicable solution between the parties, competence will be attributed to the competent tribunal in Paris, notwithstanding plurality of defendants or introduction of third parties.

 

Only the French version of this contract is an authentic version, even in the event of international use. In the event of conflict or inconsistency between the terms of the French language version of this Agreement and any translation provided by Caffè Cataldi, the French language version shall prevail.
